One of the biggest problems when performing transactions over the internet is the lack of confidence between the parties, both by consumers and companies. For this reason, Legalbono has been recognized as a provider of electronic trust services by the Energy, Tourism and Digital Agenda Ministry guaranteeing the safety and legal validity of its services according to the European regulations.

Solving the problem

Regulation (EU) 910/2014 on electronic identification and trust services for electronic transactions in the internal market (eIDAS), emerges to, as its name suggests, reinforce confidence in the provision of electronic services through the imposition of a single, common regime for all Member States of the EU which includes supervision of the provider. This assures us that when we operate with a trusted services provider, we have the certainty that the result will be optimal, since it complies with the required formalities.

What is a trusted services provider?

According to the regulation itself: “Trusted services provider, is a physical or legal person that provides one or more trust services“. Obvious, right? But this brings us to the question: What is a trust service?

Well, a trust service is the electronic service normally provided for remuneration, consisting in:

  • The creation, verification and validation of electronic signatures, electronic seals or electronic time-stamps, certified electronic delivery and certificates relating to these services, services or
  • The creation, verification and validation of certificates for authentication of web sites, or
  • The preservation of signatures, stamps or electronic certificates relating to these services”

Therefore, a trusted services provider carries out all or any of the services of trust described.

What implies to be a trusted services provider?

Each EU Member State is obliged to appoint a supervisory authority to supervise and, when necessary, to take the appropriate measures in relation to providers of trust within its territory. In Spain, that agency is the Secretary of State for the information society and the Digital Agenda, of the Ministry of energy, tourism and Digital Agenda.

Therefor, being considered as trusted services provider involves:

  • First, it indicates that the entity complies with the safety requirements in the regulation eIDAS. It also ensures that taken technical and organizational measures have been adopted to manage those risks for the safety of the services provided. This ensures an adequate level of safety and the minimization of the impact of system security incident.
  • Secondly, it allows the supervisory body to take appropriate measures when it receives information that such providers or the trusted services provided, does not meet the requirements laid down in the regulation.
  • Finally, ensures that the entity will act correctly if a security incident occurs. Trust services providers are required to notify, within a maximum of 24 hours since it had knowledge of it, to the supervisory body and relevant bodies, as well as the user affected by the incident.
